1. Introduction and About Us

Welcome to Zinkly (accessible via Zinkly.org), a social platform and community dedicated to freedom of expression, creativity, and authentic connections.

By accessing or using Zinkly, you acknowledge that you do not acquire any ownership rights in the platform or its proprietary content. You are granted a limited, revocable, non-transferable license to access and use the platform in accordance with these Terms.

Age Requirement

If you register or accept these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the legal authority to bind that entity to these Terms.

4. Account Security and Responsibilities

You agree to provide accurate, current, and complete registration information.
You are solely responsible for maintaining the confidentiality of your account credentials.
Your account is personal, non-transferable, and may not be sold, shared, or assigned.
You must immediately notify Zinkly if you suspect unauthorized access to your account.

5. Community Principles and Prohibited Conduct

You agree that you will not post, upload, or transmit content that:

Promotes illegal drugs, weapons, explicit sexual material, or unlawful activities.
Constitutes hate speech, racism, harassment, threats, or defamation.
Violates the intellectual property, privacy, or publicity rights of others.
Uses bots, scripts, scrapers, or automated systems to manipulate engagement or access the platform.
Attempts to disrupt or compromise the security or operation of Zinkly.

6. Intellectual Property Rights

All rights, title, and interest in Zinkly's software, design, trademarks, logos, branding, and platform features belong exclusively to Zinkly.org.

User Content

You retain ownership of the content you create. By posting content on Zinkly, you grant Zinkly a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, reproduce, modify, distribute, and promote your content solely for operating, improving, and promoting the platform.

7. Payments, Marketplace, Refunds, and Zinkly Coins

A. Marketplace Disclaimer

Zinkly provides a peer-to-peer marketplace that allows users to buy and sell directly with one another.

Important: Zinkly.org is not a party to any transaction between buyers and sellers. Administrators and moderators do not act as escrow services and are not responsible for disputes, scams, fraud, chargebacks, or financial losses resulting from marketplace transactions.

All marketplace transactions are conducted entirely at the users' own risk.

B. Platform Purchases & Refunds

If you purchase subscriptions, premium features, scripts, or digital products directly from Zinkly:

Approved refunds will be processed within 5–35 business days, depending on your payment provider.
Refunds are generally not available after digital content has been accessed, downloaded, activated, or used, except where a documented critical system failure caused solely by Zinkly makes the purchased service unusable.

C. Zinkly Coins (Points System)

Zinkly offers a reward system called Zinkly Coins, which are earned by participating within the platform.

Users may earn Zinkly Coins by activities including, but not limited to:

Viewing posts
Creating posts
Commenting on posts
Other eligible engagement activities introduced by Zinkly

Zinkly Coins:

Have no cash value and cannot be exchanged for real-world currency unless explicitly stated by Zinkly.
May be modified, suspended, or discontinued at any time without prior notice.
Expire automatically after one (1) year of account inactivity relating to the points system.
May also be reset if your account remains inactive (negative count of posts, community stats) for one (1) month or longer.
Are non-transferable and may not be sold or exchanged between users unless officially supported by Zinkly.

Zinkly reserves the right to remove, adjust, or revoke Zinkly Coins obtained through abuse, exploitation, automated systems, fraudulent behavior, or violations of these Terms.

8. Content Moderation and Enforcement

Zinkly reserves the right, but not the obligation, to monitor user-generated content.

We may:

Remove, edit, or restrict any content violating these Terms.
Suspend, restrict, or permanently terminate accounts.
Modify moderation systems and content visibility algorithms at any time without prior notice.

9. Platform Restrictions

You may not:

Reverse-engineer, decompile, or copy Zinkly's software or source code.
Use the platform for spam or unauthorized commercial purposes.
Circumvent security measures or access controls.
Mirror, frame, or reproduce parts of the platform without written permission.

10. Disclaimers and Limitation of Liability

Service Availability

Zinkly is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

We do not guarantee uninterrupted, secure, or error-free operation.

Third-Party Content

Zinkly is not responsible for:

User-generated content
User interactions
Third-party websites or external links

Limitation of Liability

To the maximum extent permitted by applicable law, Zinkly.org, its affiliates, owners, employees, moderators, and operators shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the platform.

11. Termination

By Zinkly

We may suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms or applicable law.

You may delete your account at any time through your account settings or by contacting support.

12. Governing Law

These Terms shall be governed by the laws of Greece, without regard to conflict of law principles.

Any legal disputes shall be exclusively resolved before the competent courts of Greece.
